According to EBIZDIR, the West Virginia Tenant-Landlord Law is a set of regulations that governs the rental of residential property in West Virginia. The law is designed to protect both tenants and landlords, and outlines the rights and responsibilities of each party. The law applies to all residential rental properties, including single family homes, apartments, duplexes, townhouses, condominiums, mobile homes, and other similar dwellings. Under the West Virginia Tenant-Landlord Law, landlords must provide tenants with certain basic rights and services. Landlords must provide tenants with a written lease or rental agreement that outlines the terms of their tenancy. This agreement should include information such as rent amount, frequency of payments, late fees, pet policies and any other applicable regulations or fees applicable to the tenant’s stay. Additionally, landlords must provide tenants with at least twenty days notice prior to raising their rent or terminating their lease. When it comes to security deposits, the maximum amount a landlord can charge in West Virginia is typically one month’s rent unless otherwise stated in the lease agreement. Landlords are also required to return this deposit within fourteen days of the tenant’s vacating the premises unless there is evidence showing damage done beyond normal wear and tear caused by tenant or guest(s). If a landlord fails to return all or part of a security deposit within fourteen days then he/she may be liable for up to two times amount wrongfully withheld plus reasonable attorney fees incurred by tenant in recovering such amounts from landlord. Late fees on rent payments past due for more than five days after due date cannot exceed 8% of one month’s rent or $50 (whichever is greater).
