According to EBIZDIR, the Nebraska tenant-landlord law applies to all residential rental agreements in Nebraska, whether written or oral. It outlines the rights and responsibilities of both landlords and tenants and sets forth certain rules that must be followed by both parties. Rent: Landlords are allowed to charge a reasonable rent amount for their rental properties, which must be paid on time by the tenant. If a tenant fails to pay rent on time, the landlord may begin proceedings to evict them from the premises. Security Deposit: Landlords may collect security deposits from their tenants, but these deposits must generally not exceed one month’s rent. Deposits must be refunded to tenants within 30 days of the date they move out of the rental unit. Lease Agreement: All leases in Nebraska must be in writing and include certain provisions such as late fees, security deposit information, pet policies and other important details related to renting a property in Nebraska. Repairs & Maintenance: Landlords are responsible for making necessary repairs to keep their rental properties safe and habitable for tenants. Tenants are responsible for notifying landlords of any necessary repairs or maintenance issues and keeping the premises clean and free from damage during their occupancy. Termination: Landlords must provide written notice at least 30 days prior to terminating a lease agreement if they choose to do so due to non-payment of rent or other violations of the lease agreement. They may also terminate leases without cause after providing written notice at least 60 days prior to termination date. Disclosures: All leases in Nebraska must include certain disclosures about lead paint hazards for units built before 1978 as well as additional fees associated with having a pet in a rental unit. It is also important that both parties understand what happens if either party fails to meet their obligations under the terms of their contract including who is responsible for paying attorney’s fees should there be litigation over breach of contract issues between parties entering into a rental agreement in Nebraska. In addition, all agreements between landlords and tenants must comply with federal laws including but not limited to fair housing laws, anti-discrimination laws, privacy laws, consumer protection laws, among others as applicable. Both parties should understand what actions they can take should they feel that their rights have been violated by either party under this law such as filing an official complaint with local authorities or taking legal action against one another if needed depending on the nature of dispute at hand. Lastly, landlords must ensure that all security deposits are returned to the tenant within 30 days of the date they move out of the rental unit.
